Terms of Use (Closed Beta)

By creating an account, accessing, or using Nomad.Healthcare (the "Service"), you agree to these Terms of Use.
These Terms are between you and Athena Technology Consulting Ltd (company no. 15813005), 2nd Floor, College House, 17 King Edwards Road, Ruislip, London, United Kingdom, HA4 7AE ("we", "us", "our"). Contact: hello@nomad.healthcare.
These Terms apply to England & Wales law and jurisdiction.
1. Closed Beta status
- • The Service is in a closed Beta phase and is provided "as is" and "as available".
- • You use the Service entirely at your own risk. The Service may contain bugs, errors, or incomplete features and may be unavailable at any time without notice.
- • We do not provide any assurance, warranty, or representation of any kind at this stage, whether express or implied.
2. Not medical advice; not a medical device
- • The Service does not provide medical advice, diagnosis, or treatment.
- • The Service is not intended to be a medical device or to replace clinical judgement.
- • Do not rely on the Service for urgent or emergency care. In an emergency, call local emergency services or contact a qualified healthcare professional.
3. Eligibility
- • You must be at least 18 years old and capable of entering into a binding agreement to use the Service.
- • If you use integrations (e.g., email), you must have the legal right to connect and authorise access.
4. Account and security
- • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- • Use two‑factor authentication where available and keep your device secure.
- • Tell us immediately if you suspect unauthorised access: hello@nomad.healthcare.
5. Your content
- • You may upload or connect content (e.g., documents, emails, files) to the Service ("User Content").
- • You retain all rights in your User Content. You grant us a non‑exclusive, worldwide licence to host, process, index, encrypt, display (to you and any recipients you authorise), and otherwise use User Content solely to provide and maintain the Service and related support.
- • You are responsible for the accuracy, legality, and appropriateness of your User Content. Do not upload content you do not have the right to process or share.
6. Email integration and queries (Gmail)
- • If you enable email integration, you are responsible for the queries you configure (e.g., filters that identify health‑related messages).
- • The Service may ingest messages and attachments matching your queries. You are responsible for ensuring the scope and sensitivity of any content you choose to ingest.
7. Sharing features
- • You may create password‑protected shares of selected records with optional expiry and view limits.
- • While we provide measures to reduce accidental exposure, recipients may still copy or capture content. You are solely responsible for what you share and with whom.
- • You can revoke or update a share at any time; however, revocation cannot prevent recipients who already accessed content from retaining a copy.
8. Acceptable use
You must not:
- • use the Service for unlawful, infringing, or harmful purposes;
- • attempt to access accounts or data not belonging to you;
- • interfere with the Service's security, availability, or operation;
- • upload malicious code or bypass technical protections;
- • misrepresent your identity or affiliation.
We may suspend or terminate your access if we reasonably believe you have breached these Terms.
9. Intellectual property
- • We own all rights, title, and interest in the Service and its underlying technology (excluding your User Content).
- • If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty‑free licence to use them without restriction or obligation to you.
10. Service changes and availability
- • We may add, remove, or change features at any time without notice during Beta.
- • We may suspend the Service for maintenance or due to security or operational concerns.
11. Data backup and retention
- • While we take reasonable steps to safeguard data, you are responsible for keeping backup copies of important files.
- • We do not guarantee that User Content will be available, intact, or recoverable during Beta.
- • You can delete individual records and your account at any time (see Privacy Policy for data deletion).
12. Third‑party services
- • The Service may depend on third‑party providers (e.g., cloud storage, email providers). We are not responsible for third‑party outages, changes, or terms.
- • Your use of third‑party services is subject to their own terms and privacy policies.
13. Disclaimers
To the fullest extent permitted by law:
- • The Service is provided "as is" and "as available" without any warranties or guarantees.
- • We disclaim all implied warranties, including fitness for a particular purpose, satisfactory quality, and non‑infringement.
- • We do not warrant that the Service will be error‑free, uninterrupted, secure, or meet your expectations.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded under applicable law. Your statutory rights, if any, remain unaffected.
14. Limitation of liability
To the fullest extent permitted by law:
- • We will not be liable for (a) loss of profits or revenue, (b) loss or corruption of data, (c) loss of goodwill, (d) business interruption, or (e) indirect or consequential losses.
- • Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed £100.
15. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your User Content.
16. Suspension and termination
- • You may stop using the Service at any time and request account deletion.
- • We may suspend or terminate access for breach of these Terms, security risk, legal compliance, or to protect the Service or other users.
- • Upon termination, your right to use the Service ends immediately.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date. Your continued use after changes take effect constitutes acceptance.
18. Governing law and jurisdiction
These Terms, and any non‑contractual obligations arising out of them, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
